Terms and Conditions
By downloading or using the web platform, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the web platform. You are not allowed to copy, or modify the web platform, any part of the web platform, or our trademarks in any way. You are not allowed to attempt to extract the source code of the web platform, and you also should not try to translate the web platform into other languages or make derivative versions. The web platform itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to ZapPay.
ZapPay is committed to ensuring that the web platform is as useful and efficient as possible. For that reason, we reserve the right to make changes to the web platform or to charge for its services, at any time and for any reason. We will never charge you for the web platform or its services without making it very clear to you exactly what you are paying for.
The Zap Pay web platform stores and processes personal data that you have provided to us, in order to provide our Service. It is your responsibility to keep your phone and access to the web platform secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware, viruses, malicious programs, compromise your phone’s security features, and it could mean that the Zap Pay web platform will not work properly or at all.
You should be aware that there are certain things that ZapPay will not take responsibility for. Certain functions of the web platform will require the web platform to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but ZapPay cannot take responsibility for the web platform not working at full functionality if you do not have access to Wi-Fi, and you do not have any of your data allowance left.
If you are using the web platform outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the web platform, or other third-party charges. In using the web platform, you are accepting responsibility for any such charges, including roaming data charges if you use the web platform outside of your home territory, i.e., region or country, without turning off data roaming. If you are not the bill payer for the device on which you are using the web platform, please be aware that we assume that you have received permission from the bill payer for using the web platform.
Along the same lines, ZapPay cannot always take responsibility for the way you use the web platform, i.e., you need to make sure that your device stays charged – if it runs out of battery and you cannot turn it on to avail the Service, ZapPay cannot accept responsibility.
With respect to ZapPay’s responsibility for your use of the web platform, when you are using the web platform, it is important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. At some point, we may wish to update the web platform. The web platform is currently available on Android and iOS – the requirements for both systems, and for any additional systems we decide to extend the availability of the web platform to, may change, and you will need to download the updates if you want to keep using the web platform. ZapPay does not promise that it will always update the web platform so that it is relevant to you and or works with the iOS and or Android version that you have installed on your device. However, you promise to always accept updates to the web application when offered to you. We may also wish to stop providing the web platform and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the web platform, and if needed, delete it from your device.
Safety
As a condition of use, you promise not to use Zap Pay for any purpose that is unlawful or prohibited by these Terms. By way of example, but not limited to, you agree not to use the web platform:
- If you are under the age of 18;
- To bully, abuse, harass, threaten, impersonate or intimidate any person;
- To transmit any digital content or communications that are libelous, defamatory, obscene, pornographic, abusive, offensive, profane, threatening, incites violence, contains nudity, contains violence, is considered hate speech, or that infringes any copyright or other right of any person;
- For any purpose that is not permitted under the laws of the jurisdiction where you use the Services;
- To transmit any communication designed or intended to obtain password, account, or private information from any other user;
- To advertise to, or solicit, any user to buy or sell any third-party products or services, or to use any information obtained from the web platform in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;
- To do anything unlawful, misleading, malicious, or discriminatory;
- To provide any false personal information on Zap Pay, or create an account for anyone other than yourself;
- To create more than one profile or use a profile that is not the true representation of who you are;
No Warranties
This web platform is provided as-is, with all faults, and ZapPay makes no express or implied representations or warranties, of any kind related to this web platform or the materials contained on this web platform. Additionally, nothing contained on this web platform shall be construed as providing consult or advice to you.
Limitation of Liability
Your use of this web platform is at your own risk. Neither ZapPay nor any other party involved in creating, producing, contributing to, or delivering the web platform is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the web platform. Without limiting the foregoing, everything on the web platform is provided to you on an as-is basis, and to the fullest extent permitted by law, without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall ZapPay, nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this web platform, whether such liability is under contract, tort or otherwise, and ZapPay, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this web platform. You are solely responsible for your interactions with other users of the web platform.
Indemnification
You hereby indemnify to the fullest extent ZapPay, its officers, directors and employees from and against any and all liabilities, costs, demands, causes of action, damages and expenses, including reasonable attorney’s fees, arising out of or in any way related to your breach of any of the provisions of these Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
Changes to Terms and Conditions
We may update our Terms and Conditions from time to time; thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.

This page is used to inform visitors regarding ZapPay policies with the collection, use, and disclosure of Personal Information if anyone decided to use ZapPay.
If you choose to use ZapPay, then you agree to the collection and use of information in relation to this policy. The Personal Information that ZapPay collects is used for providing and improving the web platform.
